Outcome 2: describe land registration

The candidate will be able to:

  • describe the purpose of land registration including benefits of registration ie to make the conveyancing process more efficient, no need to prove title
  • describe the role of the HM Land Registry and District Registries including events that trigger registration (eg sale, purchase, unregistered land)
  • describe the contents of the Register (the Property Register, the Proprietorship Register and the Charges Register, Protection of Interests by Notice and Restriction in outline only)
  • describe overriding interests including easements and rights of persons in actual occupation (basic description including protection of purchasers)
  • describe a restrictive covenant and its effect on uses of the land ie a restriction on the way an owner of land can use their land eg not able to build, operate a business, put up a fence, keep ducks.
