Outcome 3: explain how contracts
of employment can be terminated
The candidate will be able to:
- explain the main distinction between wrongful dismissal
and unfair dismissal
- describe the different remedies for unfair dismissal and
the procedures for obtaining these ie damages, re-instatement,
re-engagement
- identify specific situations where a dismissal would be
automatically unfair eg pregnancy, sexual orientation
- identify the five
potentially fair reasons for dismissal ie incapability or lack of
qualifications, misconduct, redundancy, breach of statute, some
other substantial reason eg failing to sign a new employment
contract that has been agreed through collective bargaining
- identify the
relevant pro formas used to commence an action and describe their
content ie ET1, ET3.
