Associate Prosecutors

 

IPS is the regulatory body for Associate Prosecutors.  Associate Prosecutors are employees of the Crown Prosecution Service (CPS).  They are registered in the Associate Prosecutor membership grade with ILEX. 

 

The Crown Prosecution Service (CPS) and ILEX have an agreement setting out arrangements for the independent regulation of Associate Prosecutor employees of the CPS.

 

Associate Prosecutors are authorised by ILEX to exercise rights of audience and rights to conduct litigation.  There are two levels of Associate Prosecutor: Level 1 and Level 2.  They undergo a selection and training programme before being authorised to exercise the rights.  The rights granted to Associate Prosecutors include the right to review and present straightforward cases in the magistrates' courts and at Level 2 to undertake trials involving non-imprisonable summary offences.  Full details of the Associate Prosecutor qualification scheme, including the rights available, can be found here.

 

The scheme brought Associate Prosecutors into a formal scheme of external regulation and oversight of their training and qualification scheme.  Associate Prosecutors, the public and other legal professionals have the reassurance that any allegations of misconduct or impropriety will be carefully and independently investigated and adjudicated.
