Administering oaths

 

The Institute of Legal Executives (ILEX) is a prescribed body under Section 113 of the Courts and Legal Services Act 1990.  This means it can confer on its members the powers of a commissioner for Oaths.  Under this legislation Fellows of ILEX may administer Oaths and statutory declarations.  Fellows may refer to themselves as Commissioners for Oaths.

 

The guide to the administration of Oaths can be found here.  This sets out the procedures for the administration of Oaths and includes the statutory declaration under which authorisation was granted.

 

The guide confirms that Oaths may be administered only by Fellows whose subscriptions to ILEX are up to date and who are registered as full Fellows of ILEX.  Oaths may not be administered by Fellows who are registered in the Retired Fellows grade.  The guide also explains the circumstances in which Fellows should not administer Oaths.
