Fitness to practise on health
grounds
IPS has a duty to ensure that members' fitness
to practise is not impaired on health grounds. This includes
both physical and mental impairment. IPS has impairment rules
which set out the procedure we follow in such investigations and
the powers available to us.

Where a matter comes to our attention which
suggests that a member's ability to practise may be impaired on
health grounds, IPS contacts the member concerned to ask for a
medical report and to ask for the member's comments on the
issues.
The IPS Officer considers the medical report
and any other submission provided by the member to decide whether
fitness to practise is impaired. Where the Officer takes the
view that fitness is impaired the member is suspended from
membership of ILEX until they are fit to practise. A member
seeking to have their membership restored must provide a medical
report supporting their application. If, in the light of
that, they are judged fit to practise, their membership will be
restored.
Where a member disagrees with a decision to
suspend them from practice they may appeal to the Health
Committee. The Committee will consist of two lay members and
one professional member, selected from the disciplinary
panel. The Health Committee will consider all the evidence
and decide whether to uphold or vary the decision of the IPS
Officer.
