Charge

The charges against Mr Garner were:
1.
Between 15 July 2004 and 15 August 2006, Sean Colin Garner a Fellow
of ILEX, and then a partner in the firm of Kelhams, Solicitors, of
9 Broad Street, Stamford, Lincolnshire, PE9 1PY, made false entries
on cheque stubs and payment vouchers, contrary to Rule 1(a) and (d)
of the Solicitors Practice Rules 1990 (“the SPR 1990”),
WHEREBY disrepute was brought upon the Institute
or its members.
2. On
diverse dates between 1 January 2003 and 31 August 2006 the said
Sean Colin Garner, then a partner in the said firm of solicitors
wrongfully misappropriated certain professional charges due to
Kelhams, Solicitors, contrary to Rule 1(a) and (d) of the SPR 1990,
WHEREBY disrepute was brought upon the Institute
or its members.
3. On
diverse dates between 1 January 2003 and 31 August 2006 the said
Sean Colin Garner, then a partner in the said firm of solicitors,
attempted to avoid the payment of VAT on professional charges due
to Kelhams Solicitors, contrary to Rule 1 (a) and (d) of the SPR
1990 WHEREBY disrepute was brought upon the
Institute or its members.
4. On 7
April 2009 the said Sean Colin Garner was struck off the Roll of
Solicitors by Order of the Solicitors Disciplinary Tribunal upon
Findings that the allegations set out in paragraph 1 to 3
(inclusive) were proved, and that in relation to those at
paragraphs 1 and 2, he had been dishonest WHEREBY
disrepute was brought upon the Institute or its members.
