Charge

Mr Cozens Tom Braide of London engaged in conduct unbefitting to ILEX or likely to bring ILEX or its members into disrepute contrary to Rule 1(1) of the Code of Conduct and/or conducted himself in such a manner as to cast doubt on his professional integrity contrary to Rule 1 (2) of the Code of Conduct.

 

The particulars to the charge were that:

 

Mr Braide was convicted of two counts of providing immigration advice and services in contravention of Section 84 Immigration & Asylum Act 1999.

 

Mr Braide provided immigration advice and assistance without being authorised to do so by ILEX and/or in circumstances where he was specifically not permitted by ILEX to provide such advice and assistance.

 

Mr Braide failed to undertake the work that he was instructed to complete for his client, failed to keep clients informed of the progress of cases, and failed to act in the best interests of clients.

 

Mr Braide provided misleading information indicating that he was entitled to provide immigration advice and services as a member of ILEX in circumstances where he was aware that he was not permitted by ILEX so to do.

 

Outcome    

The charge was found proved.

 

Penalty

Mr Braide was permanently excluded from membership of ILEX.  He was also ordered to pay a fine of £1,000 and costs of £1,800 to ILEX. 

 

Appeal

Mr Braide’s appeal was rejected on the basis that he had no grounds for appeal.  Mr Braide was ordered to pay costs of £1,200 in respect of the appeal.
