The charge against Mrs Gillian Lewis of
Solihull was:
Between 14 May 2004 and 22 March 2005 she
failed to conduct herself in such a manner so as to avoid bringing
disrepute upon the Institute or its members.
The particulars to the charge were that:
Between 14 May 2004 and 22 March 2005, Mrs
Lewis being an unqualified person within the meaning of Section
22(1) of the Solicitors Act 1974, trading under the style
“Precedent Legal Services” from Knowle, Solihull, acted or accepted
instructions to act for a client which involved or would have
involved the drawing or preparation of an instrument relating to
such estate.
Between 14 March 2005 and 22 March 2005 Mrs
Lewis, being an unqualified person within the meaning of Section
22(1) of the Solicitors Act 1974, trading under the style
“Precedent Legal Services” from Knowle, Solihull, acted or accepted
instructions to act for a client which involved or would have
involved the drawing or preparation of an instrument relating to
such estate.
Between 10 March 2005 and 22 March 2005, in
breach of her written undertaking to the Institute dated 10 March
2005:-
(a) Undertook conveyancing transactions,
namely those particularised at paragraphs 1 and 2 above using her
firm’s letter headed paper; and
(b) Failed to obtain written authority from
her client that she was acting in a personal capacity for no fee,
gain or reward; and
(c) Failed to inform the said client that she
was not covered by indemnity insurance.
