Misconduct

The first charge against Mrs Kelly was that she failed to comply with principles 2, and/or 3 and/or 5 of the Code of Conduct. 

 

The particulars of the charge were that Mrs Kelly:

(1) in the course of her employment failed to maintain high standards of professional (or personal) conduct in that she:-    
(a) caused or permitted, deliberately or otherwise, a quantity of active client papers, then in the custody of her employer, to be exposed to destruction; and/or         

(b) concealed from her employer a quantity of active client papers delivered to the employer in connection with professional instructions; and/or        

(c) concealed from her employer by deletion a quantity of electronic communications from one or more clients of her employer delivered in connection with professional instructions; and/or    

(d) failed to conduct certain employment duties diligently and/or adequately and/or at all namely the processing, recording and reporting of client instructions;          
(2) By reason of the matters set out in paragraph (1) failed to behave with honesty and integrity towards her employer and/or its clients and/or her colleagues;
(3) By reason of the matters set out in paragraph (1) failed to act in the best interests of her employer’s clients. 

 

The second charge against Mrs Kelly was that she failed to comply with and respond to reasonable enquiries made by or on behalf of the Officer in connection with a complaint of professional misconduct. 

 

The particulars of the charge were that Mrs Kelly:

(1) failed to respond to reasonable enquiries made of her by IPS in connection with complaints of professional misconduct made by or on behalf of her former employer.

 

Outcome    

The charges were found proven.

 

Penalty

The Disciplinary Tribunal ordered that Mrs Kelly be excluded from membership of ILEX for a minimum period of three years.  Mrs Kelly was ordered to pay costs to IPS.
