CLC: Proposed Amendment to the Application by the CLC to the
LSB to be designated as a Licensing Authority Standard of
Proof
Consultation from the Council for Licensed Conveyancers (CLC) on
its application to the LSB to be designated as a Licensing
Authority. The consultation contained proposals for all
disciplinary and enforcement proceedings to be decided on the civil
standard of proof rather than on a sliding scale from the civil
standard to the criminal standard, as originally proposed. The CLC
also proposed that the civil standard of proof would apply to those
regulated by the CLC as a Licensing Authority and as an Approved
Regulator and would ensure consistency with the standard of proof
applied by the First Tier Tribunal of the General Regulatory
Chamber and with other regulatory bodies. The consultation closed
on 27 April 2011.
